Description for 2021/22

Equity & Trusts introduces the student to the development, role and
significance of Equity and equitable principles. It also promotes a sound
understanding of general principles of trust law and refines, through
research and problem solving, the ability to deal with the technicalities
of the substantive law of equity and trusts.

Aims
Together with Equity 2, to provide a coherent overview of the central role of equity in private law. This module will focus upon the nature and types of trust; the rules and formalities that underlie the creation of a trust (particularly those concerning the certainties and constitution of trusts); and the deployment of the trust in the spheres of the family home and charities. The module will promote an understanding of the history and policy through critical engagement with case law and academic commentary.

Intended Learning Outcomes

Understand the nature and role of the trust and how to distinguish it from other types of legal relationship: 1

Description of Module Assessment

1: Open Book Examination weighted 100%
24-hour online open book exam
The word limit for the assessment is 3,000 words. Students must answer two questions from a choice of five. The paper will contain a mix of essay questions and problem scenarios. The questions carry equal weight. The paper will be released on the KLE at 10am on the morning of the exam. Students will have 24 hours to submit their answers. Although 24 hours has been allocated as the time frame within which answers must be submitted, we expect that most students will take no more than 2-3 hours to complete their answers. Answers must be completed and submitted in accordance with the Law School approved rubric for 24-hour online assessments.

Please note that for the 2021/22 Academic Year all programmes will be adapted to operate in accordance with a flexible, digital approach.
